
Wills
A Will is a document that lets
you tell the Probate Court: who will manage and distribute
your estate, who will inherit your estate, who will raise
your minor children, and the age at which you want your
children to receive their inheritance. A Will is the
traditional document for doing all of the above plus more.
While some people continue to rely solely upon a Will for
the disposition of their estate, most people today tend to
be a little more sophisticated in their estate planning; and
the Will becomes just one of the documents that is used to
accomplish the above goals. The decision lies in part on the
size of the estate. Use of a Will by itself will require
that your estate go through probate. This may not be to the
advantage of your heirs, since it can be costly and can tie
up assets for one to two years. We evaluate every clients
needs individually to determine the best estate planning
vehicles - the ones that will permit the quickest, easiest
and least costly distribution of assets.
Living Trusts
Living Trusts do
everything a Will does... and in addition, they also avoid
the time and expense of probate and may save you thousands
of dollars in federal estate taxes.
As a rule, a Living
Trust enables you to transfer as many of your assets as you
wish into the name of the Trust, thereby avoiding probate.
You can be the trustee, thereby making all decisions about
the assets. You can have the right to end it any time you
wish.
Who needs a Living
Trust? Anyone with an estate that would be subject to
probate should have a Living Trust. In California, this can
include homeowners and those who have an estate of more than
$100,000 (including pension plans and life insurance to your
heirs).
